1. Introduction

These Terms and Conditions govern your use of MindFuddle (“the service”). By creating an account, accessing, or using the platform, you agree to these Terms and Conditions. If you do not agree, you must not use the service.

2. About the service

MindFuddle is a practice platform that allows users to take part in whiteboard or design-style challenge sessions, interact with artificial intelligence tools, and receive responses, scoring, or feedback based on submitted content.

We may update, improve, remove, or change parts of the service from time to time.

3. Eligibility

You must be at least 18 years old to use the service.

By using the service, you confirm that:

  • you are legally able to enter into a binding agreement
  • the information you provide is accurate and up to date
  • you will use the service only in accordance with these terms and applicable law

4. Accounts

You may need to create an account to use some or all parts of the service.

You are responsible for:

  • keeping your login details secure
  • all activity that takes place under your account
  • promptly notifying us if you believe your account has been accessed without permission

We may suspend or disable accounts that violate these terms or put the service or other users at risk.

5. Acceptable use

You agree not to misuse the service.

In particular, you must not:

  • use the service for unlawful, harmful, abusive, or fraudulent purposes
  • attempt to gain unauthorised access to the platform, accounts, or systems
  • interfere with the operation, performance, or security of the service
  • upload or submit malicious code, spam, or harmful content
  • copy, scrape, reverse engineer, or exploit the service beyond what is permitted by law
  • use the platform in a way that could damage, disable, or overburden the service

6. User content

You may submit content through the service, including practice session messages, responses, uploads, and other materials you choose to provide.

You remain the owner of the content you submit.

However, by submitting content through the platform, you grant us a limited, non-exclusive, worldwide licence to host, store, process, reproduce, and display that content only as reasonably necessary to operate, maintain, secure, and improve the service.

You are responsible for ensuring that you have the right to submit any content you provide and that it does not violate any law or the rights of others.

7. Artificial intelligence outputs and feedback

The service may generate chat responses, scoring, summaries, or feedback using artificial intelligence systems.

These outputs are provided for informational and practice purposes only. They may be incomplete, inaccurate, inconsistent, or subjective.

You should not rely on AI-generated output as professional, legal, educational, hiring, career, or other specialist advice.

8. Paid plans, billing, and subscriptions

Some parts of the service may be offered on a paid subscription basis.

If you purchase a paid plan:

  • you agree to pay the fees shown at the time of purchase
  • payments will be processed by Stripe or another third-party payment provider
  • we do not store full card details ourselves
  • your subscription will renew automatically at the end of each billing period unless you cancel before the next renewal date

You are responsible for providing current and valid payment information through the payment provider.

We may change pricing, features, or plan limits in the future. Where required, we will give reasonable notice before those changes take effect.

9. Free access and plan limits

We may offer a free tier, trial access, limited accounts, or promotional access with usage limits or restricted features.

We may change or withdraw free features, limits, or eligibility at any time.

10. Intellectual property

All intellectual property rights in the service, including the platform design, branding, software, text, graphics, layouts, and underlying materials, belong to us or our licensors unless stated otherwise.

We grant you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose in accordance with these terms.

You must not copy, modify, distribute, sell, licence, or otherwise exploit any part of the service except as permitted by law or with our written permission.

11. Availability and changes

We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

We may suspend, withdraw, modify, or discontinue all or part of the service at any time, including for maintenance, security, legal, or business reasons.

12. Suspension and termination

We may suspend or terminate your access to the service if:

  • you breach these terms
  • you misuse the platform
  • your use creates legal, security, or operational risk
  • we are required to do so by law

You may stop using the service at any time.

Any provisions of these terms that are intended to survive termination will continue to apply after access ends.

13. Refunds and cancellations

You may cancel your subscription at any time through your account settings, if available, or by contacting us.

Unless otherwise stated, cancellations take effect at the end of the current billing period, and you will continue to have access until that period ends.

Payments are non-refundable except where required by law or where we choose to provide a refund at our discretion.

14. Limitation of liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or loss of profit, revenue, business, opportunity, goodwill, or data arising out of or in connection with your use of the service.

To the fullest extent permitted by law, our total liability to you for any claims arising out of or relating to the service will not exceed the greater of £100 and the amount you paid us for the service in the 12 months before the claim.

15. Privacy

Your use of the service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data.

We may also use strictly necessary cookies or similar technologies required for core site functions such as authentication, security, and payment processing. If we introduce non-essential cookies in future, we will update our notices and, where required, request consent.

16. Changes to these terms

We may update these Terms and Conditions from time to time.

When we do, we will post the updated version on this page and update the “Last updated” date above.

Continued use of the service after updated terms take effect means you accept the revised terms.

17. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of England and Wales.

The courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with these terms or the service, unless applicable consumer law says otherwise.
